Unlabeled or Contaminated Foods

When a person has an allergic reaction to food, they experience what is called Anaphylaxis Shock in which their airway becomes severely restricted by muscle contraction and they are unable to breathe. Once the reaction has started, treatment is needed immediately or the person could die. Allergic reaction symptoms include:

  • Intense abdominal pain
  • Trouble breathing and swallowing
  • Swollen tongue, lips, throat, eyelids
  • Coughing
  • Wheezing
  • Hives
  • Dangerously accelerated heart rate
  • Anxiety
  • Pale coloring
  • Low blood pressure
  • Loss of consciousness
  • Death

Proper labeling on food containers and proper warnings at restaurants on the ingredients in the food is crucial to the livelihood of people with food allergies. Failure to do so could result in a lawsuit against the manufacturer or restaurant.

Proper Food Labeling

In 2004, the Food Allergen Labeling and Consumer Protection Act (FALCPA) food manufactures, suppliers, and distributors were required to label any ingredient that was a known food allergen. Among the extensive number of allergen listed there were:

  • Eggs
  • Specified dairy products
  • Specified seafood
  • Tree nuts
  • Peanuts
  • Soybeans
  • Wheat

The food administration is finally starting to see how common and diverse food allergies are. Proper labeling goes a long way when it comes to saving a life.

Manufacturers Duty to Protect Consumers

Human beings need food to live, so it’s important to know what’s in the food we eat. Since we depend on grocery stores and restaurants to serve us food that won’t harm us, we trust that they will properly label foods that may have potentially harmful ingredients. The following organizations have a responsibility to the public to be knowledgeable of and label foods that cause an allergic reaction:

  • Manufacturers
  • Distributors
  • Restaurants
  • Cafeterias
  • Hospitals
  • Nursing facilities
  • Cruise ships
